Edwards Kirby Announces Collective Class Action Filed against Digicon For Failure to Pay Overtime Wages


Washington, D.C. Digicon is a government contractor that provides IT services for local, state and federal governments, as well as commercial companies across the U.S. The case was filed in late September on behalf of the numerous individuals nationwide whom Digicon employed as information technology service staff, but failed to pay overtime wages as required by law. The plaintiffs assert that Digicon unlawfully withheld overtime compensation in violation of the Fair Labor Standards Act and state laws throughout the U.S. The complaint alleges these employees were deliberately misclassified as exempt from overtime laws by Digicon. As a result, Digicon improperly withheld overtime wages despite the fact that the workers did not meet the criteria for any exempt classification recognized under the law. The collective and class action includes individuals employed as information technology services staff, including technicians, analysts, support analysts, customer support analysts and desktop technicians, across the company’s numerous worksites.
